Welcome to KenyaMall.net! These Terms and Conditions ("Terms") govern your access and use of our website and the services we offer (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access or use the Service.   

1. Introduction

KenyaMall.net is an online store owned and operated by KenyaMall. We offer a variety of products for purchase by cash on delivery (COD) within Kenya.

2.  Eligibility

The Service is intended for use by individuals who are at least 18 years old and reside in Kenya. By using the Service, you represent and warrant that you meet all of these requirements.

3.  Orders and Payment

  • Placing an Order: You can place an order for products offered on our website by following the on-screen prompts. We reserve the right to refuse any order for any reason.
  • Payment: We currently only accept cash on delivery (COD) as a payment method. The full amount of your order must be paid in cash upon delivery. You will be notified of the total amount due before your order is confirmed.
  • Pricing and Availability: All prices listed on the website are in Kenyan Shillings (KES). We reserve the right to change prices without notice.  Product availability is not guaranteed and may change at any time.

4.  Delivery

  • We deliver orders within Kenya only. You will be responsible for providing a complete and accurate delivery address.
  • Delivery times are estimates and may vary depending on your location and other factors.
  • We are not responsible for any delays in delivery caused by factors beyond our control, such as weather events or carrier disruptions.
  • You will be contacted to arrange a delivery time once your order is processed.

5.  Returns and Refunds

  • We offer a 7-day return policy for unopened and unused products. You must contact us within 7 days of receiving your order to initiate a return.
  • To return an item, please contact us by email at contact@kenyamall.net and provide your order number and the reason for your return.
  • Once we receive your return request, we will provide you with instructions on how to return the item. You will be responsible for the cost of return shipping.   

  • After we receive and inspect the returned item, we will issue a full refund to the original payment method used for your purchase. Please allow up to 10 business days for the refund to be processed.
  • We reserve the right to refuse any return that does not comply with our return policy.

6.  User Content

You may be able to submit reviews, comments, and other content ("User Content") to the Service. You are solely responsible for all User Content that you submit.

7.  Intellectual Property

The content on the Service, including all designs, text, graphics, logos, images, and other materials ("Content"), is the property of KenyaMall.net or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any Content without our prior written permission.   

8.  Disclaimer

The Service is provided "as is" and without warranty of any kind, express or implied. KenyaMall.net disclaims all warranties, including, but not limited to, the warranties of merchantability, fitness for a particular purpose, and non-infringement.   

KenyaMall.net does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the server that makes it available are free of viruses or other harmful components.   

9.  Limitation of Liability

In no event shall KenyaMall.net be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including, but not limited to, lost profits, data loss, or personal injury, even if KenyaMall.net has been advised of the possibility of such damages.   

10.  Indemnification

You agree to indemnify and hold harmless KenyaMall.net, its officers, directors, employees, agents, and licensors from and against any and all claims, demands, losses, liabilities, costs, or expenses (including attorneys' fees) arising out of or related to your use of the Service.

11.  Termination

We may terminate or suspend your access to the Service at any time, for any reason, without notice.

12.  Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya.

13.  Changes to the Terms

We reserve the right to change these Terms at any time.
